1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the website located at capture-films.com (the "Site"), owned and operated by Capture Films LLC ("Capture Films," "we," "us," or "our"), headquartered at 55 N University Ave, STE 210, Provo, UT 84601. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. About Capture Films

Capture Films LLC is a full-service cinematic video production company serving national and international clients, with operations based in Utah and Hawaii. Information on the Site regarding our services, past work, team, and capabilities is provided for general informational purposes only.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law

  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or systems connected to the Site

  • Introduce viruses, malware, or other harmful code

  • Scrape, data mine, or use automated tools to extract content from the Site without our prior written consent

  • Impersonate Capture Films or any of its employees or representatives

  • Interfere with or disrupt the Site or any servers or networks connected to it

4. Intellectual Property

All content on the Site, including video, photography, graphics, logos, text, and design elements, is the property of Capture Films LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Reels and case studies displayed on the Site may include work produced for clients; that work remains subject to the ownership and usage terms established in the applicable client production agreement.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written permission, except as necessary to view the Site for personal, non-commercial purposes.

5. Client Services and Production Agreements

Inquiries, quotes, proposals, or discussions initiated through the Site do not by themselves create a binding agreement for production services. All video production, creative, and related services are governed by a separate, signed production agreement or statement of work between Capture Films LLC and the client, which controls scope of work, deliverables, fees, ownership or licensing of final deliverables, timelines, and other terms specific to that engagement. If these Terms conflict with a signed production agreement, the production agreement controls for that engagement.

6. Submissions and Inquiries

If you submit information through a contact form, email, or other means on the Site, you represent that the information is accurate and that you have the right to share it. We may use this information to respond to your inquiry and otherwise as described in our Privacy Policy.

7. Third-Party Links

The Site may link to third-party websites, including social media platforms, vendors, or partners. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site. Visiting linked sites is at your own risk.

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure, or error-free. Capture Films makes no warranty regarding the accuracy, completeness, or timeliness of any information on the Site.

9. Limitation of Liability

To the fullest extent permitted by law, Capture Films LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of, or inability to use, the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Capture Films LLC and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of the Site or your violation of these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site is subject to the exclusive jurisdiction of the state and federal courts located in Utah County, Utah, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to the Site with an updated "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
